General terms and conditions of av edition GmbH

§1 Scope

The following general terms and conditions govern business relations between av edition GmbH (referred to here as the Vendor) and the Purchaser.

§ 2 Order

You have the possibility to browse through our offering. If you find something that interests you, place the product in your virtual shopping cart by clicking on the small shopping cart symbol that appears on the product. You can, of course, remove it again from your shopping cart at any time.

The order process is triggered when you click on the “shopping card” button. You will now see the products which you have added to the shopping cart. At this point, you can remove products from the shopping cart again. To continue the order process, press the “Proceed to checkout” button. Here you will be asked to log in with your user data or as new customer to to set up a user account or to process the order as a guest without registering.

Before sending off your order by clicking the button “Buy now”, you have the possibility at this stage of the order process to correct your order by clicking the “Edit” button.

Clicking the “Buy now” button triggers your order which is passed on to us. By placing an order you have made a firm commitment to purchase the goods.

§ 3 Contract

By placing an order, you enter into a contract with av edition GmbH.

You will be informed immediately about the receipt of your order by an email with the subject line “New Order #”. The order confirmation is triggered automatically and does constitute acceptance of the contract. We save the text of the contract including your order and upon request this can be sent to you together with our general terms and conditions.

The contract is closed in German.

§4 Subject to availability

We reserve the right not to execute your order if we do not have the title you have ordered in stock, the out-of-stock title is out of print at the publishers and the goods ordered are thus not available. In this case, we will inform you without delay that the item is not available and immediately refund any purchase price you have already paid.

§5 Shipping costs

We do not charge any shipping rate for deliveries within Germany. For deliveries within the EU and to Switzerland we charge a shipping rate of EUR 9.50. For overseas deliveries, our dispatch department selects the most favourable method of dispatch for you.

§6 Payment

The purchase price is due and payable without deduction within 14 days of invoicing. Bank transfers are made to account of Stuttgarter Verlagskontor SVK GmbH at BW Bank Stuttgart Int. bank account number: DE 98 6005 0101 0002 3070 86, S.W.I.F.T.-BIC SOLADEST600). Invoices can also be paid by credit card.

§7 Retention of title

The goods remain the property of Vendor until the purchase price has been paid in full.

§8 Warranty

The statutory warranty rights apply.

§9 Applicable law and court of competent jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Sales Convention. If the Purchaser is a businessman or legal entity under public law, the exclusive court of competent jurisdiction for all disputes arising from the contract is the court responsible for our registered offices in Stuttgart.

Return instructions

Right of return
You can return the goods received within two weeks by sending them back without giving reasons. The period allowed for return begins upon receipt of the goods and these instructions. To observe the period allowed, it is sufficient to dispatch the goods in time. In any case, the return is at our expense and risk. Returns will only be accepted in the original boxes (shock-proof packaging). Goods should be returned to the following address:

Consequences of returns In the event of a valid return, the performances received by the two parties shall be returned and any benefits drawn shall be surrendered. If the goods have deteriorated, indemnification may be demanded. This does not apply if the deterioration of the goods is solely attributable to their inspection, as would for example be customary in a retail outlet.

You can avoid an indemnification obligation by not using the goods like an owner and desisting from anything which could adversely affect the value.
